These General Terms and Conditions apply to our agreements, online registrations and Planny driving school application in which services, advice and other work are offered by Xpress Rijopleiding.nl, unless the parties have expressly agreed otherwise in writing or digitally.
Our counterparty in the General Terms and Conditions is hereinafter referred to as "course participant".
Xpress Rijopleiding.nl offers practical and theory courses for the categories car, motorbike, moped and trailer. In which the course participant makes their own online purchases for the driving lessons, exams and their learning materials.
These General Terms and Conditions and all online applications of Xpress Rijopleiding.nl are governed by Dutch law.
Article 2. Agreement
If any of the provisions in the online or paper registration form, the other provisions remain in full force and effect.
Article 3. Applications
Course participant can register with the driving school by requesting trial lesson online viahereand also pay online via iDeal.
Course member will receive confirmation of trial lesson via e-mail after payment via iDeal info@xpressrijopleiding.nl.
Each type of trial lesson lasts between 55 and 110 minutes (depending on the trial lesson type). The duration depends on when the driving instructor has gained a sufficient picture of the student's driving ability.
By scheduling a trial driving lesson, the student agrees to these Terms and Conditions.
If the student does not show up to the trial lesson, no fees will be refunded. Trial lessons should therefore be cancelled 48 hours in advance.
Article 4. Obligations of Xpress Rijopleiding.nl
Xpress Rijopleiding is obliged to ensure:
That driving lessons are given by driving instructors who comply with the provisions of the Motor Vehicle Driving Instruction Act (WRM)
That the student receives as much driving instruction as possible from the same driving instructor;
That the application for the driving ability examination (hereinafter: the examination) is submitted by the student himself via cbr.nl.
That the duration of the driving lesson to be given, as agreed, is 110 minutes. This includes lesson preparation, vehicle driving, any refuelling and the conclusion of the driving lesson.
That insurance has been taken out with an excess of 500 euros. Xpress Driver Training does not cover this liability to the student;
Making the student aware that any medical complaints, which he/she can reasonably expect to have an impact on the competence to drive a motor vehicle, may affect the application and conduct of an examination;
Alert the student to the fact that it is on the basis of residency status whether a driving licence can be issued;
Alerting the student to the fact that as soon as there is a disqualification to drive motor vehicles, he must notify Xpress Rijopleiding.nl.
Students who end up in a traffic jam during the driving lesson will only be refunded the lost minutes if the driving lesson started within the exam area. Students picked up outside the exam area are unfortunately not eligible for compensation.
Article 5. Obligations of the student
The trainee is obliged:
To adhere to the driving school software Planny. This records; lesson agreements, agreed lesson arrangements, payments and progress of the entire driving course.
Xpress Rijopleiding.nl applies a waiting time of 15 minutes. Failure to appear at the agreed lesson time without timely cancellation will result in the full lesson price being charged.
Pay the full lesson price if the driving lesson is cancelled within 48 hours according to the agreed lesson time which is in Planny is registered.
Cancellation should be arranged online yourself via Planny.
If cancelling by telephone, this must be done during the office hours of Xpress Rijopleiding.nl. It is not possible to catch up a (missed) driving lesson. The prepaid lesson fee is also not refundable in this case.
In case of cancellations, no charge will be made only if the cancelled driving lesson(s) are from Planny have been removed. Course participants are responsible for checking the cancelled appointment. As soon as the appointment remains visible in the agenda, the course participant is responsible for this and will be charged for it.
To follow all directions and lesson advice given by the driving instructor during the driving lessons. Students who fail to reach the exam level while already having an exam date cannot be taken to the exam. The final responsibility lies with the student to reach the level early. This can only be achieved by taking enough driving lessons.
Comply with the lesson package and advice agreed with Xpress Rijopleiding.nl, such as the lesson components to be taught and the number of driving lessons to be taken per week, until the exam date;
To present a valid identification document and, if required, a valid theory certificate (or valid replacement document) at a driving skills examination (theory test, intermediate test or other subtest, driving test and Further Examination);
To coordinate any medical complaints, of which he/she can reasonably expect that they may affect the authorisation to drive a motor vehicle, with the examination centre in good time before the driving course starts. If the student fails to do so and the driving course must therefore be interrupted or cut short, Xpress Rijopleiding.nl cannot be held liable for this;
To convince himself that he needs to authorise the trainer with the DigiD code via cbr.nl as well as request a health declaration for the driving licence category concerned. Xpress Rijopleiding.nl cannot be held liable if the student cannot take the exam if the authorisation or health declaration is missing;
To report if there is a disqualification to drive motor vehicles. If the student fails to mention this, Xpress Rijopleiding.nl cannot be held liable
To follow the driving instructor's instructions during driving lessons; In serious cases, such as reckless driving or other very (deliberate) inattentive driving where the instructions are not followed, the driver will be held liable of the resulting damage.
To participate in the driving lessons and examination sober or not under the influence of alcohol, narcotics or medicines that may affect driving ability.
Pay traffic fines imposed by an official during motorbike and moped driving lessons.
To indicate in writing themselves if they do not want to appear on social media accounts, such as Facebook, Instagram, Youtube, of Xpress Rijopleiding.nl through a photo or video.
Paying close attention to the driving instructor's instructions. Students who lose their driving instructor during moped or motorbike driving lessons due to miscommunication, inattention or traffic congestion cannot be reimbursed for the missed driving lesson.
Carry a mobile phone during a moped or motorbike driving lesson, so that the student can contact the driving instructor in time if they have lost each other during a driving lesson. This allows the driving instructor to find the student in time to resume the driving lesson.
Course participants must always carry valid proof of identity with them regardless of whether it is a driving lesson or exam. It is the student's responsibility to take care of this themselves, as they are legally obliged to be able to identify themselves in public places. A photo is not a valid proof of identity!
Xpress Rijopleiding.nl uses DigiD data from students to reserve theory and practical exams. Once an exam is reserved, the student is informed of the reservation by the CBR by means of an E-mail. It is the responsibility of the student to keep track of the exam date, time and place himself or herself if it is in Planny is included and inform the driving instructor accordingly.
Article 6. Payments
Xpress Rijopleiding.nl is entitled to charge an administration fee for any additional services such as telephone contacts with the CBR , web developer, accountant, calculation work, etc. The cost for this is 49 euros per activity.
Unless the parties have expressly agreed otherwise in writing, payment for the driving course shall be made by iDeal.
Xpress Rijopleiding is entitled to adjust its lesson prices during the period of registration.
Any driving lessons, exams, learning aids or learning packages are purchased online by the student themselves, with the student also paying online via iDeal.
After purchasing a product Planny of the student is automatically upgraded with balance in minutes.
It is not possible to schedule driving lessons before the student through Planny purchased the products and paid online via iDeal. Unless the driving instructor/office makes an exception for this.
Occasionally, due to a system error, additional balance may be allocated to the student or the driving instructor himself may add balance to schedule driving lessons. In return, the student is expected to make payments on time. It is the responsibility of the course participant himself to be aware of the amount of minutes for which a payment has/has not been made. Course participants are not entitled to a refund on minutes for which no payment has been made.
Lesson packages can be paid in instalments. However, in some cases there are surcharges on top of the selected lesson package. The surcharge is also paid online via iDeal.
Validity of each product sold is valid for 1 year only. After the validity, the student is not entitled to a refund of the course credit or CBR exams.
Article 7. Gift voucher
Gift vouchers worth 75 euros are offered in all some lesson packages. These gift vouchers are not intended for personal use. Redeeming them is only possible with a student who is not yet a client of Xpress Rijopleiding.nl and also does not have a car driving licence.
Gift vouchers can only be redeemed when purchasing a lesson package. It cannot be used for single driving lessons.
Article 8. Trial examination
Xpress Driver Training works with a trial exam system. This is a 55-minute driving lesson with a different driving instructor who tests the student's level. This shows whether or not a student is exam-ready.
A mock exam should be scheduled in consultation with the driving instructor.
Trial exam starts and ends at the Mercure Hotel in Amsterdam at Naritaweg 1. The student must be willing to come to this exam area himself.
If the assessment of the mock exam positive is, then the student is given permission to book a practical exam.
If the assessment of the mock exam negative is, then the student should continue driving lessons until the appropriate level is reached. Then, another trial exam should be requested for reassessment.
Are you not willing to follow the advice of the driving instructor who took the trial exam? If so, the driving course will be discontinued and the remaining money refunded. Xpress Rijopleiding.nl does not reserve exams to students who want to try the exam!
If a driving course is interrupted by the student or Xpress Rijopleiding.nl because the lesson advice is not followed. Then dissolution takes place in accordance with Article 10.3.
It is not possible to cancel the exam and claim money back.
Article 9. Indemnification
Xpress Rijopleiding indemnifies the course participant against claims from third parties as a result of collisions, collisions and traffic violations that have taken place during the driving lesson and/or examination. Incidents such as, traffic fines, not listening to the instructions of the driving instructor and/or reckless driving resulting from intent and/or gross negligence of the course participant, as well as in the case of the use by the course participant of alcohol, narcotics or medicines which may influence driving ability, are excluded from this indemnification.
If the course participant takes a driving lesson despite the fact that he and/or she has been denied the right to drive motor vehicles by judicial decision and/or his and/or her driving licence has been confiscated, and the statement made at the conclusion of the lesson agreements is therefore incorrect, the course participant shall fully indemnify Xpress Rijopleiding for the consequences thereof. The student shall fully reimburse any fines imposed in this respect, as well as all other financial consequences for his and/or her account.
Article 10. Dissolution
Any Terms and Conditions ticked/signed by the student when creating a Planny account is considered binding by Xpress Rijopleiding unless the student cancels the agreement by letter or e-mail within 14 days of ticking.
If the course fee is paid in advance by the student, Xpress Rijopleiding will refund the amount to the student after deduction of administration costs of 49 euros, the driving lessons taken, theory course and examination fees paid to CBR due to passing the examination.
When refunding, the course participant should take into account that the action prices of the lesson packages are only valid once the driving course is continued up to and including the last CBR practical exam. If the course participant stops the driving course halfway through without taking an exam, Xpress Rijopleiding regards the driving lessons taken as separate lessons. In this case, the single driving lesson rates and not the promotional prices of the purchased lesson package will be taken into account in the calculation.
A booked theory or practical exam cannot be cancelled. In such cases, Xpress Driver Training cannot refund the exam fees.
Artikel 11 –Klachtenprocedure
Indiening van klachten Klachten over de totstandkoming en uitvoering van de overeenkomst, de kwaliteit van de rijlessen, of andere dienstverlening van Xpress Rijopleiding.nl dienen volledig en duidelijk omschreven te worden ingediend via e-mail: info@xpressrijopleiding.nl.
Termijn van indiening Een klacht dient zo spoedig mogelijk, doch uiterlijk binnen 14 dagen nadat de leerling het gebrek of de tekortkoming heeft geconstateerd, te worden ingediend.
Behandeling van klachten Xpress Rijopleiding.nl bevestigt de ontvangst van de klacht binnen 5 werkdagen na ontvangst. Binnen 14 dagen na ontvangst van de klacht ontvangt de klager een inhoudelijke reactie. Indien een langere behandeltermijn noodzakelijk is, wordt de klager hiervan schriftelijk op de hoogte gesteld met een indicatie van de verwachte afhandeltermijn.
Oplossing Xpress Rijopleiding.nl zal zich inspannen om de klacht in onderling overleg en naar redelijkheid op te lossen.
Geschillen Indien een klacht niet in onderling overleg kan worden opgelost, ontstaat een geschil dat wordt behandeld conform het bepaalde in deze algemene voorwaarden en het toepasselijke Nederlands recht.
